KARLSRUHE, GERMANY - Although many are saying that this is a very sad day for marriage and families, Germany's top court has dismissed efforts to block a new law which will allow gay couples in Germany to be wed in registry offices, to share a common surname, and to have to get a divorce if the union doesn't last. Additionally, same-sex couples will also have all the rights that heterosexual spouses have in areas like inheritance and health insurance. Foreign partners of German gays and lesbians will now be allowed to join them in Germany.

The law which was passed by parliament will go into effect on August 1, 2001. It has been considered a milestone by the gay community and an attack on traditional family values by conservative groups. There is also concern about the impact the law will have on sex education in schools.

The law will not qualify same-sex partners for a tax benefit that married couples receive, "spousal splitting". Same-sex spouses will also not be allowed to adopt a child.

There is still another court case pending concerning the new law. A decision is expected next year by the constitutional court as to whether or not the law violates the German constitution.

Similar laws have been introduced in France and Norway. Same-sex marriages for Dutch citizens or people with residency permits were legalized in the Netherlands in April, 2001.
