Stating that their marriage is legal because he is legally a man, Thomas Beatie and Nancy Roberts announced in March 2008 that Thomas was pregnant.

3/29/2013: Maricopa County Family Court Judge Douglas Gerlach said he had no jurisdiction to grant a divorce to Thomas Beatie because there is "insufficient evidence that Beatie was a man when he married Nancy Beatie in Hawaii." The judge also ruled that Nancy and Thomas would co-parent their children with joint authority in making legal decisions.

According to the Daily Mail, they were married in Honolulu, Hawaii in early 2003. Thomas and Nancy shared they had been married for five years on The Oprah Winfrey Show in April 2008. Thomas and Nancy were married after he was legally considered a man in the state of Oregon.

Susan Juliette Beatie, the daughter of Thomas and Nancy, was born in the summer of 2008 in Bend, Oregon. Their first pregnancy, an ectopic pregnancy, ended in the summer of 2007.

Their second child, a son, Austin Alexander Beatie, was born in 2009.
